This is a Proposal for:      General Assembly

Proposal:
Emergency Proposal for General Assembly: Sign declaration demanding Congress’ call to assemble an Article V Constitutional Amendment Convention as 49 of 50 States have applied for. We still have time to elect delegates in the 2012 election.

We involved with Inter-Occupy Article V Work-group unanimously acknowledge the fact that the States have satisfied the required two-thirds numerical threshold to call for an Article V Convention under Article V of the US Constitution and Congress should call an Article V Convention to order.

We offer the attached data to support our agreement of fact.

Corporations and wealthy individuals have crowded out voters from being heard by elected officials in the legislative process and as the primary resource of candidates in their campaigns. As a result, our government can no longer be considered truly a government of, by, and for the people.

The States have done their part in asking for a Convention to amend the United States Constitution. A Convention would give the people the ability to make the changes needed to fix what’s wrong with our political system. It is time for Congress to do its duty and call a Convention to amend the United States Constitution as required by Article V of the Constitution.

The record is clear, the reality that Congress is remiss in their duty is clear. If the power of Congress is to ignore, then Occupy and the States must acknowledge the record as fact. The truth is on our side. The States must begin the delegate selection process immediately. If we cannot wake the States up by the end of April we will not get another chance to elected delegates until 2013. We are ready now.  All we have to do is shame a Congress with a 9% approval rating that they will not call this convention to order.

The only option left is the public pressure we can create. This is a political choice as much as a legal choice now. We have the records to wave in their face. Once 20 Governors are waving the records, Congress will call the convention and we will be able to propose amendments. We are running out of time. We need to involve this message in national actions, this is our Constitution to amend.

The States have satisfied the required two-thirds numerical threshold to call for a National Constitutional Convention under Article 5 of the US Constitution. Seize the day!

    Here is a clip from Occupy Las Vegas where the local occupation met with conservative Sheriff Mack, who says that if Occupy acknowledges the Constitution, we’re all on the same page. That’s what it’s going to take to win freedom back from the 1%. Not just Occupy can do it alone. Please consider this proposal, it lays the case bare. It’s our Constitution–it’s our law. Who? Us! the 99%!

    Self-Determination

    Local level government, i.e. county, is the basic level to encourage relations with. While all areas have this access, for some it’s the only one. Build from this level to your hearts content. It’s the last line of defense and the first line of defense. It’s the only one that counts. New York’s finest, however, don’t deserve existence. No good comes from their mercenary ways. They’re a stain on America, and despised nation-wide.

    The Federal government must fall and be rebuilt, since it has already destroyed its purpose. State governments are timid cowards at their masters feet. Make nice with the county, and work what you want done. It requires adjustments, as does any life which desires to survive.

    Rebuilding the Federal part may not be what you want, or want to do, however, consider it. There are ways inherent, proper, and outside of federal control. Of course it requires working with the state. It sucks either way.

    Cynicism runs deep here and is understandable. Formal political parties should be outlawed. They serve no one of importance, since they don’t serve you. The citizen is the base of all authority. If enough can be organized, they can take back what they want. This is where self-determination comes in.

    Remember, the source of authority and power is from you and you alone. It’s being misused by Republicans, Democrats, Conservatives, Liberals, and all the other labels THEY make up. Take back what is yours. Sitting and waiting serves not you. Build stronger groups. It’s not easy, but neither is fighting for freedom. Freedom is a constant battle, because most of the people elected are afraid, so they create prisons from cities. Their fear is lack of control over you. Their thinking is backwards at best. Politeness restricts me further.

    How you decide is your choice. Many outside this area support a range of ways to accomplish the objective. With the objective in sight, it’s a matter of coordination.

    No amount of weapons and cruelties can stop non-violent struggle. Peace is unknown in Washington DC, New York City, Oakland, and around the country. Peace will kill the Federal government, and the quicker the better. Peace is something foreign to the white house dictator and the other war criminals surrounding him. Peace will mean death to our dictators and I fully support this action. Can you imagine being guilty of using peace as a weapon?

    This is the full text of the motion passed in Inter-Occupy Article V Work Group.

    What is an Article V Convention?
    The only direct way citizens can propose amendments to the Constitution of the United States.

    Why should OWS do this?
    Because OWS stands for fundamental changes to our democratic institutions and such a convention, an institution unto itself, is our brightest hope towards bringing about these changes.

    What would OWS be proposing as amendments?
    This is something that needn’t be answered specifically at this time. We can say now though, that our moniker—Occupy Wall Street—is a direct statement about where we see a fundamental problem, the solution to which must take place outside the current nexus of government and corporate institutions.

    The proposal today is not about what amendment(s) to discuss and debate at a convention. It is simply about supporting the idea of holding a convention because we recognize it is the only way we citizens can participate directly in our constitutional form of government.

    If OWS gets behind the Article V Convention it will create the awareness and political circumstance necessary to bring it about.

    This is great news; supportng use of our constitutional right to an Article V convention is exactly what the Occupy movement should do. Reform constitutional amendments are the only way to restore American democracy and remove it from the grip of the 1 percent. The only thing to fear is sticking with the status quo and all the corruption and dysfunction that is ruining our country. Do not believe the propaganda of those propagating fear about using the convention option; those people and groups who now navigate the corrupt system to exert power are deeply afraid of the convention option; what they fear we must embrace.

      are you in NYC? we need someone to present this on behalf of inter-occupy article V work group. we are scattered around the country. we are trying to pass this up the food chain for approval. once OWS acknowledges we are ready to call a convention, it should not take too long before it is a reality. we are ready to amend now. it is our constitution, we get to do that. ;)

    and we know how to stop ALEC from doing what they have been doing for decades ?

    ALEC is little more than a tax-exempt screen for major U.S. corporations and trade associations that use it to influence legislative activities at the state level. ALEC allows these corporations to do what they couldnt attempt directly or openly without risking public criticism. They funnel cash through ALEC to curry favor with state lawmakers through junkets and other largesse in the hopes of enacting special-interest legislation all the while keeping safely outside the public eye. The organizations behind-the-scenes advocacy has been surprisingly effective leading to th e enactment of more than 450 state laws during the 1999 and 2000 state legislative sessions. ALEC is nothing less than a tax-exempt facade for the country’s largest corporations and kindred entities.
    Companies likes Enron, Amoco, Chevron, Shell, Texaco, Coors Brewing, Koch Industries, Nationwide Insurance, Pfizer, National Energy Group, Philip Morris, and R. J. Reynolds pay for essentially all of ALECs expenses. ALEC was directly responsible for spewing the Florida stand your ground laws into 22 other states
    Environment is an especially popular target for ALEC, which is currently promoting more than two dozen industry bills related to energy and environmental protection. According to one staff member, the goal is to break the “stranglehold” of the command-and-control policies promoted by the EPA (Environmental Protection Agency) and the extremist environmental lobby.

      OK, so since ALEC believes in an article V convention, that means we shouldn’t? Because ALEC has an idea how to turn that to their benefit, we can’t find a way to help ensure it doesn’t benefit them, but the people it’s meant to benefit? Just as a gun can be a tool for great good, or a fast driven car for the same method, it’s the one behind the controls that makes it good or bad. We are bigger than ALEC. We the people are stronger when standing together as a collective. The goal is to get us standing together in numbers so ALEC cannot influence it towards their means and agenda, not to avoid it simply because ALEC wants to corrupt it. Our goal should be to find ways of ensuring ALEC does NOT corrupt it.

        Simply because we think Article V is a good idea, that means we’re following ALEC? How can you say such things when clearly, those involved presently with this are doing so for the good of the people and not the corporatocracy?

      Going back a few weeks ago, the article v group was inappropriately associated with 99d group. This seemed unwarranted considering article v group had no plans for a july 4 philly convention, no plans for selecting delegates and no plans to endorse grievances.

      Once again, the artivle v group is inappropriately associated with alec group. I don’t know anything about alec and article v group hasn’t had any discussions about alec. And I question article v members chasing another distraction of this sort.

      This document should be a good guide regarding differences between article v group and alec group. article v group is not advocating a balanced budget amendment. article v group is not calling for a convention for the primary purpose of proposing a specific amendment. article v group is calling for a convention because it is the law of the land that Congress has ignored. Although this is beyond the scope of the GA proposal, article v group encourages Occupations to advocate amendment(s) to end symbiotic relationship between politicians and lobbyists/PACs/wealthy individuals.

        No Britt..this group was NEVER associated with 99%D. It was said that this group had some X MEMBERS of 99%D, and that it does. I am one of them that left 99%D when it became painfully apparent that 99%D is about the personal agenda of the founder and nothing more.

        As for chasing, I’m not sure what you’re talking about Brit as the ONLY reason I’ve disputed things is because it was suggested that somehow, in some way, seemingly by the above posts by Eric, that we were supposedly somehow joining ALEC when we’re not and in no way support nor condone ALEC.

    I got the idea that there might be hundreds/thousands/… of people (politically active people) who might be motivated to join this movement for an Article V Convention and who are third-party candidates for President (running for election this year), their staff and their supporters. My thinking: Who would be more interested in reform in Washington and looking for ways to highlight what is wrong with the status quo in Washington and who would be looking for ways to position themselves as friends of the people…? So, I sent the following letter to the national campaign offices of many of these third-party political parties…

    (Subject Line:) We all want change in Washington. So, why are we not focused on what is common to all of us, so we can unite and empower ourselves to achieve that goal? It is that simple.

    Dear friends of liberty, justice, honor and truth in America:

    We (more about who we are in a moment) would like to hear every candidate for President, who is not a Democrat or a Republican, make these remarks in every speech prior to the national election this November…

    “The two major political parties in Washington are not just silencing the voices of third-party candidates in the presidential election debate by banning them from nationally televised debates. The duopoly in Washington is far more destructive to life and liberty on Main Street in America than even those citizens who are Occupying public squares or attending Tea Parties realize. Most of these citizens, who represent the most informed and most politically engaged among the citizenry – even these citizens are unaware of the fact that Congress has deleted the most sacred right we possess from our most sacred protection of our rights as American citizens: our Constitution. This right – our right to amend our Constitution – is among the rights that should never be challenged by any federal authority. Our rights to speak openly and to assemble peacefully and to have access to a free press, as well as other
    rights, should never be challenged in this nation.

    “Our Founders knew well the pain of life under the oppression of an unjust authority. This personal experience inspired their design of the new republic they envisioned and even the most nationalist among our Founders, Alexander Hamilton, steadfastly insisted upon the inclusion in the Constitution of an iron-clad protection of the sovereign power of the people and the states against what many of the Founders feared most about the creation of a central government: the potential for abuses of a corrupted federal authority. Article V in our Constitution was the embodiment of this protection of the right of We the People to amend our Constitution – our last hope, if our federal government ever became so corrupt that it no longer represented the will of the people.

    “If there is one thing about which citizens on Main Street in America today understand and agree, it is the fact that Washington is not representing the will of the people. The polls have demonstrated this to be true for many years regarding many issues that are vitally important to most Americans. Whether the issue is ending the wars, or fiscally irresponsible federal borrowing and spending, or dependence on foreign oil, or public funds for bank bailouts, or protections from bank frauds that cause destruction of wealth nationally and globally, or many other issues, Americans understand that they are not being represented in Washington and they are mad as heck about it. A nine-percent approval rating of Congress is not a vote of confidence in the status quo in Washington – that is clear.”

    We submit that if Americans WERE generally aware of the fact that Congress has eliminated the one protection in our Constitution that USED TO empower We the People to amend our Constitution and which COULD HAVE enabled us to restore the representative democracy that has been taken from us by this corruption in Washington, Americans would, by the millions, sit up and pay attention; stand up and ask questions; and speak up and demand REAL change in this election year. They would demand that Congress call an Article V Convention. Congress has, by refusing to obey Article V in the Constitution, willfully deleted this right of the American people from the Constitution: our right to amend our Constitution. The legal facts have been established in two legal actions (Walker v. U.S. and Walker v. Members of Congress – one of which went up to the Supreme Court): Per Article V, Congress must (it is peremptory – they have no discretion) call an amendatory (Article V) convention when two-thirds of the states have submitted applications; a simple numeric count is what triggers the obligation of Congress to call the convention (neither age, nor subject matter, nor anything else, excludes any applications from being counted); that threshold (required number of state’s applications) has been achieved (more than 700 applications from 49 states have been received by Congress per the Congressional record); Congress, in REFUSING (they voted on the matter) to call a convention – all members of Congress, as of 2006 and since – have violated their oaths of office (a federal criminal offense); etc.

    We further submit that any candidate and/or any political party which is involved in the distribution of this message – this message of hope and much more than just hope; a message of empowerment – any such messengers will be perceived as true leaders; leaders who are working for the people and with the people for change that will, without question, improve the lives of Americans and brighten the prospects for their children and grandchildren to live their lives free from the threats that this corruption imposes (and will continue to impose) upon them (the burdens of student debt, continuing stagnation (or worse) in the economy and the threat of further global financial crises, increasing taxes (caused by national debt, endless war, rising health care costs, crumbling infrastructure, etc.), deteriorating global environmental conditions, etc.).

    We ask you to join and to take on a leadership role in this movement in America to demand that our constitutional right to amend our Constitution be protected by those who have sworn to protect those rights (Congress) – a movement in America that will certainly be a historic movement by We the People that will restore representative democracy in America and engage citizens on Main Street in America in a democratic process (the first Article V Convention in our nation’s history) that promises to be one of the most inspiring national experiences in modern American history.

    Please take a moment to consider the last time the American people were united; truly (not falsely) hopeful about the future; inspired by something in which they all can participate and something in which they all can take ownership and something about which they can truly be proud.
    This potentially inspirational and deeply moving national experience is achievable and we believe it is right there in front of us for We the People to realize, if we just would reach out for it (we see it as low-hanging fruit, essentially).

    Please send us your questions, concerns – any feedback you might have.
    But, please, do not wait too long before you decide whether or not you are going to join us and/or help us lead this movement. We believe that this is the one hope, our last hope, that We the People have to restore our republic. We must act and we must act immediately to take advantage of the hunger (and anger) on Main Street in America for REAL change. We must fix this broken political process in Washington that forms a barrier to America realizing the future that we all know is within our grasp – and we must unite in order to achieve this goal.

    John French… IF… the OWS movement… could… collectively wake up to.. the idea of actually demanding a constitutional convention… and had…. very good… amendments to propose… then yes…. IT COULD GAIN MASSIVE SUPPORT…. IF… THE PROPOSED AMENDMENTS… are clear.. and based in reality… and would actually solve the major problems…..

    I put forth only one… at this time… as the truth is… many… cannot even read that.

    But yes… such an effort… is exactly what the OWS movement needs…. an effort for real change.

    I offer my service to help with this… and I encourage anyone who has the nerve to fight for this.. to pick up the phone… and call me… organize with me… let us start real work on this… and make a big deal of it.

      mo, OWS cannot call a convention, we can only push congress to call it. the last thing we want is a court challenge that anything we end up ratifying is unconstitutional and tossed out. subtle difference in how we say it but it is important. we have to make sure that our comments are directed at congress. it is congress who is denying this right to alter and abolish. they have exclusive control, but it is our constitution not theirs. we are ready to amend it now.

    A convention in itself… does not solve anything, unless there are good amendments ready to go… and can be handed to members of congress… so that THEY… CAN PROPOSE IT.

    Hence… i offer one good amendment… to fix a major problem…. namely the loss of Common Law freedom… WE ALL LOST FREEDOM IN 1933…. but we can get it back if we try hard enough to get it.

    Freedom vs Civil Liberties : In 1933, they literally took away constitutional freedom and rights and protections, and gave the people something else, called Civil Liberties, which is granted at the pleasure of the Federal Government, and slowly over the past 80 years, they have created more and more RULE based laws, ‘statute laws’ which the people are forced to obey, 66 million laws and counting, ALL OF WHICH IS UN-CONSTITUTIONAL, when applied to actual people.

    THEY took away the protection of the common law legal system, as provided for in the Constitution, and forced all the people into 14th amendment Federal citizenship, and Social Security corporate status, without our clearly informed understanding, so that they may enforce endless laws on us, most especially taxation, under penalty of prison, which is something they simply could not easily do in a constitutional common law court. (So, those who favor taxes, found ways to change the system and rob the people.)
    We got ripped off.
    The problem here, typically is that the average American does NOT realize what the Common Law is… or was. So, let me explain, as simply as I can.

    Under the Common Law AS IT WAS BEFORE 1933, it was difficult if not impossible to force the masses of people TO PAY TAXES, and the Federal government was completely unable to write laws applicable to the Free People, and so, in order to enforce an income TAX on the people, they had to get around the Constitution and the Common Law legal system it provides, which prevented the Federal government from being able to FORCE TAXATION, by law, as by the point of a gun and prison… I.e… Under Common Law freedom, any failure to pay income taxes, was not a jailable offence, since under the Common Law, no damage or harm had been done, and the only way to legally allow for enforcing income taxes under the Common Law, would be by constitutional amendment, stating clearly the powers of enforcement… An amendment which would be difficult if not impossible to pass, even today.
    THEY FOUND A WAY around the Common Law legal system….. by changing the legal system… which is something the Federal government HAS NEVER BEEN EMPOWERED TO DO.

    Civil liberties, were established in 1933, as part of the NEW DEAL OF 1933. Prohibition, being a perfect example of the difference between constitutional freedom and government imposed Civil Liberties…. such that before 1933, they had to have a constitutional amendment to prevent our free people (you and me) from having the god given right to consume Alcohol or anything else for that matter, because under the constitutional legal system, being the Common law… people are free to do what they wish, posess what they wish, in all ways, always, as long as they do no harm and do not infringe on the rights and freedom of any other people, or damage any property.
    THAT WAS REAL FREEDOM… PROVIDED BY THE COMMON LAW!!!
    BUT in 1933, THEY TOOK AWAY freedom, and they gave us Civil liberties, by forcing us all into 14th amendment Federal citizenship.
    That is key, because this form of citizenship was not required before 1933, until when FDR used emergency war powers to force it upon the people. WHICH IS UNCONSTITUTIONAL!!!
    That is key… because in the 14th amendment, it states, we are under the jurisdiction of the Federal Government. (as the United States).

    It says, United States, which legally, means, the Federal Government, to distinguish it from state governments. And it says clearly, it… provides privileges and immunities, which free people as state citizens did not need, do not presently need, and would not want, if they are subject to the common law, as free people.

    Amendment 14 – Citizenship Rights. Ratified 7/9/1868. (at end of civil war!)
    1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

    This was a protection given to ex-slaves, who at the time had no protections under the Common law, and so this 14th amendment was written to protect them.
    As 14th amendment citizens, the Federal government gained the power to write and impose statutes to define the actual effective limits of their Rights, and by law could protect them, by demanding that all state courts prosecute them, only in accordance with Federal statute laws. (Which was not required for prosecuting any free people, who were state citizens who were as such only prosecutable in a constitutional Common Law court.)

    In other words… it was at the time, that there were two kinds of citizens.

    1) Free people…. as Constitutional state citizens, with Common Law Protection.
    2) Ex-slaves (Freed people)… with NEW Federal citizenship, to protect them from abuse.

    The NEW DEAL of 1933 ”’made us all”’ into Ex-slaves, with no Common Law protections.

    Is that right????????? HELL NO!!!!!!!

    again… do you know why the government can write any law it wants to control the people????? its because as dicsussed above… they took away freedom in 1933… / 1938.. they used emergency war powers to change the entire legal system, so the government can write laws.. to take away guns.. to create drug laws.. and control the people in every way… and that… IS NOT FREEDOM…. NOT AT ALL… WE LOST FREEDOM.
    WE MUST GET IT BACK… OR CONTINUE TOO SUFFER FROM ABUSE OF POWER.
    PERIOD.

    I was just told, “You have to have a dedicated point person–there has never been a mechanism to present absentee props. There is always a specific presenter.”

    Sorry this is unacceptable. We are spread out all over the country. We are trying to alert OWS about a Constitutional crisis that we may have great control over as Occupy. This is an emergency proposal because there are election deadlines to consider. This is a proposal from Inter-Occupy to OWS. Frankly I don’t give a damn if there has never been a mechanism to present absentee proposals. I know this is not your system but considering the people who are suffering physical harm in the streets, I must respectfully insist that someone read this short proposal on our behalf. My desire is to demonstrate that there is a peaceful way to create the biggest power shift in human history and we can begin now. This IS what OWS is here to do, there is no doubt in my mind. I am desperate to get your assistance. We don’t have to put one more person in harm’s way. If anyone else gets hurt because this information is not available to them, It won’t be for a lack of persistent effort on our part. There has not been any objection to this proposal in the site, just debate about what amendments may come up.

    Help us for the next Scott Olson or UC Davis students. This is dire. I cannot walk away from this when we are this close and right now in this election year. This is a significant time period over the next 15 days. It can change everything if you help. Please.

      I am in Hawaii. I am 1/4 way around the planet from NYC. We have another member of inter-occupy coming to NYC today from Penn. It stinks that he has to take a train, but tickets, etc. just to read a short proposal that is directed to the NYC GA from Inter-Occupy work groups.
