Therefore, let We the People move forward by taking the necessary actions to change and improve our political system using Direct Democracy at the federal level via a National Citizens’ Ballot Initiative based on the “first principles” procedure. According to Washington, Jefferson, and other “Founding Fathers”, “first principles” means that all republics and representative democracies are grounded and vested in the sovereign majority vote of We the People. At the Continental Convention in 1787, which ratified our U.S. Constitution and created our new nation, the majority of Colonial voters in each state sent their representatives to this convention to vote on their behalf. As a consequence, our entire U.S. government and especially our three branches –the Judiciary, Executive, and Legislative –are all concrete creations emanating from the majority vote and sovereign will of We the People! What is the National Initiative for Democracy? The National Initiative for Democracy (NI4D.US process) is a citizens’ legislative procedure that would allow We the People, independently of Congress and the Executive branch, to propose and vote directly on three laws of our own choosing each year. If a majority of Americans voted in favor, they would automatically become law. That’s direct democracy at work. The NI4D process consists of a Constitutional amendment and a Federal law. The Democracy Amendment,a proposed amendment to the Constitution of the United States of America, will:
1. recognize the legislative power of We the People to make laws; 2. permit We the People to amend our US Constitution via a majority vote in November of every year; 3. create an Electoral Trust to administer the procedures established by the Democracy Amendment and Act. The Electoral Trust will be comprised of one representative per every million people in each state, elected by a majority of citizens in that state; 4. outlaw the use of funds from non-natural persons (for example corporate funds) in initiative elections under this article, and 5. outlaw non-natural persons (for example corporations) from sponsoring initiatives under this article.
The Democracy Act,a proposed federal law, will:
1. set out deliberative procedures to be used by citizens to create federal laws by initiative; 2. describe the key responsibilities of the Electoral Trust which shall administer the initiative process on behalf of We the People.
The National Citizens’ Initiative does not change or eliminate Congress, the President, or the Judiciary. Laws created by initiative must still stand up in the courts just like laws created by Congress. The National Citizens’ Initiative adds an additional check ––the sovereign voice of We the People ––to our system of checks and balances, while setting up a working partnership between We the People and their elected representatives. This will help to hold our Congress accountable because they now realize that if they fail to represent and execute “the will of the people”, we will do it ourselves! The Democracy Act
The Democracy Act December 3, 2011 (as authorized by the NYC OWS General Assembly) THIS ACT, establishing legislative procedures and an administrative agency, will empower and permit the citizens of these United States to exercise their legislative power; and it will be added to the Federal Code. HEREBY, Let It Be So Enacted By We the People Of These United States:
1. TITLE. This act shall be known and may be cited as the Democracy Act. 2. PREAMBLE. We the People of these United States do inherently possess the sovereign authority and power to govern ourselves by majority vote. We asserted this power in our Declaration of Independence and in the ratification of our Constitution. Therefore, We the People do hereby choose now to participate as lawmakers in our local, state, and national governments. We the People shall hereby exercise our legislative powers by national, state, and local initiative concurrently with the same legislative powers that we delegated to our elected representatives. THEREFORE, We the People, decide now to enact this Democracy Act, establishing a “Legislature of the People, by the People, for the People”. NECESSARY FUNDING: To date, over 12,000 people have signed up to vote for this Amendment and Democracy Act. However, in order to get it passed into law using the “first principles” procedures as outlined in www.NI4D.US,we need one more vote than a majority of Americans who voted in the most previous national election. Today, that number would be 60 million votes plus one.
In order to hire an Internet marketing company with the proven capability to make our National Citizens’ Ballot Initiative Campaign go viral to reach 100 million voting Americans, I propose that we receive $25,000 in funding from the NYC General Assembly, OWS, for the first year of our campaign. This will enable us to get 10 million ballot initiative signers or voters who will then provide the necessary energy and e-mail interconnections to garner 100 million signers and voters. After the first year, we will raise our own funds to finish this National Citizens’ Ballot Initiative Campaign during the following two years. So far, we have identified nine outstanding Internet marketing companies who may be able to assist us, but we will need an additional 25 days of careful review and discussion with them to determine which one can best do the job. As everyone knows, this campaign must be conducted professionally with highly skilled people. The Democracy Foundation, a 501(c) 3 not-for-profit organization, has agreed to administer any funds that the NYC GA OWS might decide to allocate. This not-for-profit foundation has a Board of Directors to insure financial accountability and has been in business for 12 years.
There are no words in the US Constitution that empower We the People to directly pass amendments to our Constitution or to directly pass laws of our own choosing, but there are also no words granting Congress the exclusive right to do so either. Therefore, just as “We the People” here at the NYC OWS have self-empowered our own General Assembly to pass proposals, — We the People, by the sovereign majority power invested in us by God, Mother Nature, and all humans, — due hereby declare that we are rightfully and justifiably self-empowered to pass amendments to our Constitution and three new laws of our own choosing each year using the “first principle” tools of Direct Democracy.
